I'm Being Threatened

I received an email tonight from someone who claims to be the GM of Channel 6 here in Richmond. He is threatening to sue me for two of my blog posts. One post that mentions how I'm in love with Channel 6 newscastor Lee Mahaffey that I posted three weeks ago here, and the other mentions a run-in with News 6 anchor Ric Young and how he may or may not be a bad tipper, posted (3 months ago) here.

Here's the email I received:


Jack the bartender,

I have just reviewed your blog site and I want to request that you immediately remove the false, damaging, and salacious statements you’ve made about WTVR/WUPV Anchor/Reporters Ric Young and Lee Mahaffey. If this material is not removed in 24 hours (by 500pm Thursday, October 1, 2008) I will ask our attorneys to prosecute you and your web hosts to the fullest extent of the law. If you have any questions about this request, or WTVR’s intent, contact me at the number below.

Now I'm automatically going to assume that this email is a hoax because I very seriously doubt Channel 6 would get their pannies in a bunch over two funny blog posts. I'm pretty sure that when you're in the public eye you have to be able to handle the occasional joke and until a judge tells me to remove the content, I won't be removing the posts. Plus if this is a real email, the other local media outlets will undoubtedly be all over Channel 6's decision to pick on a poor blogging bartender and his webhosts (which is Google by the way), but I digress...

I'll tell you one local TV personality who can take a joke though... that's right, you guessed it, "Jimmy D" Jim Duncan. I bet Jim Duncan is reading this post right now and laughing his finely toned ass off about how his competitors are little crybabies.

PS: Juan "Muthafuckin" Conde is probably getting a good laugh about this too. That is, if he's not too busy pimp slappin supermodels and sippin on Johnnie Walker Blue. That's right, you go Juan!

IANAL but I looked at those posts and you don't appear to say anything untrue about either party. All you were doing is reporting what the waitress told you.

There clearly was no malice in those two blog posts and if anyone could show how I defamed Lee Mahaffey or Ric Young I'd be very impressed.

I doubt a major news station would get upset over those two posts. If that is a real letter then they're going to look really silly.

No law against salaciousness, but Vuhginyuh is one of those states where lawsuit proffering is nearly a blood sport.

Man you must've really upset Ric Young. Restaurants all ovet town now refuse to seat him because of his (now well known) tipping habits. Haha.

Piet- ??? I'm sort of waiting to see what happens. The email address it got sent from is pretty legit.

I gotta work in a few hours though so maybe I'll be getting a summons to appear in court while I'm serving up margaritas tonight.

JGF: I think this is some creative writing on your part. Clearly, Channel 6 is a metaphor for some ill-gotten booty. You recently took down a confessional piece about your poor performance in the sack. Is there a lady who didn't want to be featured on your site and is she now threatening to take some kind of retrobution on you? Jack Goes Bobbitt, anyone?

I wrote the original email. Since you have not removed this material, I will now give you until 500 pm Friday, October 10, 2008 to remove it. Since I know absolutely nothing about the law on defamation, libel or slander; and in particular with public figures (ie NY Times vs Sullivan, 376 U.S. 254), if 5:00 pm Friday Oct 10 should pass without action, I will ask our attorneys to challenge you to a bare-chested knife-fight, subject to agreement on bowie knives, kicking the nuts, etc.

Sorry, bad fear and loathing reference. I would tend to think this is complete bs unless they are trying to make themselves look worse. Nothing like that would be sent via email from the GM. It would (and definitely should) come directly from their attorney. And how can their attorneys "prosecute" anything? Didn't know lawyers in private practice could prosecute these days. Whatever you do, do not remove the posts. Even if it is real channel 6 has no right to trample on the first amendment just to defend the fragile egos of their reporters. I'm kinda hoping it is real, maybe you can become a local first amendment martyr.

I would not rule out this email being real for one reason. I have known television and radio station general managers and broadcasters. They simply are not quite as smart as others might expect/think/hope they would be. It would not surprise me to find out that a station manager or their assistants might not understand the first amendment.

I learned long ago never to ascribe to malice (i.e. a phony email) what can be accounted for by simple incompetence (i.e. a station manager with more testosterone than brains).

The twit should sue himself because its his own email that is making him look bad.

You have every write to state your opinion... that's what Blogger is for!

As for WTVR, I used to be a "weather watcher" for Storm Team 6. In my opinion, the only "great" thing about WTVR are the anchors and reporters.

I have made several visits to the station, and have watched live newscasts. Ever since a few new guys in management moved in last year, the station has been totally a wreck. As you know, several reporters were let go, and if I am correct, we really don't even know what company will buy WTVR, so I can't imagine how everyone is feeling day to day, wondering if they're still going to have a job or not.

Also, when management let the former Chief Meteorologist go in 2007, it was a total outrage. Why let someone go after being there almost 10 years and knows what he's doing? It makes no sense to me. So ever since then, and these changes, *in my opinion* no matter what anyone says, until that station gets a great boss that actually "has brains" and can get these ratings, the station will just continue to go downhill.

But, you have every right to post, it's free speech. I just think he's afraid everyone will know the truth about how crappy the station is getting...well, it's not new... he needs to get a life, and RESIGN -- he has to taste or style, in my
"opinion" (which he doesn't seem to understand..going to sue someone over people's opinions, give me a break...childish)
